1. Who we are
Unreal Engineering ("we", "us") is Ryan Vimba doing business as Unreal Engineering, Houston, Texas. These terms cover the store-operations software we provide by subscription (the "service").
2. The subscription
The service is $299 per location per month, billed to a card on file on the 1st of each month, plus sales tax where required. Customer text messages beyond the included amount are prepaid, as described on our pricing page. Prices can change with 30 days' notice by email.
3. Cancellation and refunds
You can cancel at any time by emailing hello@unrealengineering.co. The service runs to the end of the paid month and there are no further charges. Monthly fees are not refundable, except for billing errors. Prepaid text credit that has expired is not refundable. Please email us about any charge before disputing it with your bank.
4. Your account and your data
You are responsible for the people you give access to and for what they do in the service. Your data (your schedules, counts, menu, customers and messages) is yours. We use it only to run the service for you and to support you. You can ask for a copy or for deletion at any time; we delete it within 30 days of the end of your subscription unless the law requires us to keep it longer.
5. Text messaging
The service can send text messages to your staff and, where they have opted in, to your customers. You are responsible for having each recipient's consent and for the content of the messages you send. Messages that break the law or carrier rules may be refused.
6. Third-party services
The service connects to Square (your point of sale), Stripe (billing) and a text-messaging carrier. Their terms apply to your use of them. We are not responsible for their outages or changes.
7. Availability and support
We aim to keep the service running all the time, but it may be unavailable for maintenance or for reasons outside our control. Support is by email and we answer as quickly as we can.
8. Limits of liability
The service is provided as is. To the extent the law allows, we are not liable for lost profits or indirect damages, and our total liability for any claim is limited to the fees you paid in the three months before the claim.
9. Changes and governing law
We may update these terms; we'll email you about material changes before they take effect. These terms are governed by the laws of Texas.
